1. Acceptance of Terms
By accessing or using TripSet ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We may update these terms at any time; continued use of the Service constitutes acceptance of the updated terms.
2. Description of Service
TripSet is a travel planning platform that allows users to create, publish, share, and discover travel itineraries. The Service includes AI-assisted ticket import, itinerary cloning, an explorer marketplace, and related features.
3. Account Registration
- —You must provide accurate and complete information when creating an account.
- —You are responsible for maintaining the confidentiality of your account credentials.
- —You must be at least 16 years old to create an account.
- —You are responsible for all activity that occurs under your account.
- —We reserve the right to suspend or terminate accounts that violate these Terms.
4. User Content
- —You retain ownership of the itineraries and content you create on TripSet.
- —By publishing content publicly, you grant TripSet a non-exclusive, royalty-free license to display, distribute, and promote that content on the platform.
- —You must not post content that is illegal, harmful, defamatory, or infringes third-party intellectual property rights.
- —We reserve the right to remove content that violates these Terms without prior notice.
5. Prohibited Uses
- —Scraping, crawling, or automated data collection without prior written consent.
- —Impersonating other users or creating fake accounts.
- —Attempting to gain unauthorized access to the Service or its infrastructure.
- —Using the Service for any unlawful purpose or in violation of any applicable regulations.
- —Posting spam, misleading content, or malicious links.
- —Uploading documents belonging to third parties through the AI import feature — you may only import tickets, bookings, and travel documents that belong to you personally.
- —Publishing itineraries that promote illegal activities, travel to sanctioned regions in violation of applicable law, or content that glorifies harm to persons or animals.
- —Posting sexual, pornographic, or explicitly violent content in any form — including text, photos, or embedded media.
- —Posting content that constitutes hate speech, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality.
- —Including personal URLs, referral links, affiliate links, promo codes, QR codes, or any other promotional material in itinerary text, descriptions, notes, or photos — whether embedded in the image or written in the caption.
- —Uploading photos that contain visible watermarks, brand logos, QR codes, or text overlays serving an advertising or self-promotional purpose.
- —Publishing photos of identifiable individuals without their explicit consent.
- —Fabricating place names, addresses, prices, or other factual information in itinerary content.
5a. Content Moderation
- —TripSet reviews reported content and may remove any content that violates these Terms without prior notice.
- —We aim to review reports within 5 business days. Complex cases (copyright disputes, legal requests) may take longer.
- —If your content is removed, you will be notified by email with a brief reason. You may appeal by contacting legal@tripset.io within 14 days.
- —Repeated violations will result in progressive enforcement: specific content or photo removal, temporary suspension, and permanent account termination.
- —We reserve the right to remove content proactively if it poses an immediate risk of harm, without waiting for a report.
- —The following violations result in immediate and permanent account termination without prior warning or right of appeal: (a) any content that sexually exploits or endangers minors; (b) credible threats of violence against identifiable individuals or groups; (c) automated abuse, mass spam, or coordinated attacks on the platform or its users; (d) any violation committed after a prior account suspension for the same or a similar breach.
6. Marketplace Transactions
- —TripSet operates as a platform ("Platform") that connects creators of travel itineraries with users who wish to clone or purchase them. TripSet is not a party to any transaction between a creator and a user.
- —Free cloning: users may clone publicly available itineraries at no charge. A cloned itinerary is delivered as an editable copy in the user's own account. The user is responsible for verifying and adapting the content before relying on it for travel.
- —Paid itineraries: where a creator charges for access to an itinerary, the sale is a direct transaction between the creator and the user. TripSet facilitates payment processing through Paddle but does not warrant, endorse, or guarantee the quality, accuracy, or completeness of any paid itinerary.
- —Complaints about paid itineraries: disputes regarding content quality, completeness, or accuracy of a purchased itinerary must be directed to the creator. TripSet may, at its sole discretion, mediate disputes and issue refunds on behalf of creators in exceptional cases.
- —TripSet's liability in connection with any marketplace transaction is limited to the amount paid to TripSet (platform fees), not the purchase price of the itinerary.
7. Intellectual Property (Platform)
The TripSet name, logo, design, and proprietary software are owned by TripSet and protected by applicable intellectual property laws. You may not use these without our express written permission.
8. Disclaimer of Warranties
- —The Service is provided "as is" without warranties of any kind, express or implied.
- —TripSet does not guarantee the accuracy, completeness, or currentness of any itinerary, whether free or paid. Travel information — including hotel availability, prices, transport schedules, visa requirements, and attraction opening hours — changes frequently and may be outdated.
- —A cloned itinerary is a starting point for planning, not a guaranteed travel plan. Users must independently verify all critical information before travel.
- —TripSet is not liable for any travel disruption, financial loss, injury, or inconvenience arising from reliance on itinerary content created by third-party creators.
9. Limitation of Liability
To the maximum extent permitted by applicable law, TripSet shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service or any marketplace transaction, including but not limited to lost profits, data loss, travel disruptions, or dissatisfaction with purchased itinerary content.
10. Governing Law and Dispute Resolution
These Terms are governed by applicable international law. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by binding arbitration under the Rules of the International Chamber of Commerce (ICC). The language of arbitration shall be English. Nothing in this clause prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.
